REGULATION
FOR GRANTING FOOD SUSTENANCE AT PUBLIC CANTEENS /SOUP-KITCHENS/

PART I
General Conditions
Art. 1. Granting food sustenance at public canteens /soup-kitchens/ by the Bulgarian Red Cross is carried out in accordance with the order established by the present Regulation.
Art. 2. The Bulgarian Red Cross grants food sustenance to physical persons as per the requirements for social assistance in accordance with Part II of this Regulation.
Art. 3. Granting food sustenance is free and is realized in strict observation of all operative principles of the International Movement of the Red Cross and the Red Crescent as well as the operative legislation of the Republic of Bulgaria.
Art. 4. The food is served / distributed at easily accessible and specially equipped accommodations in accordance with the sanitary and hygienic requirements of the Hygiene Inspection Authorities, and having the indications of the Bulgarian Red Cross sign.
Art. 5. The accommodations appropriated for the purpose of canteens /soup-kitchens/ have to be suitably furnished and equipped in strict observation of all sanitary requirements.
Art. 6. The beneficiaries are entitled to choose whether to have their meal at the canteen /soup-kitchen/ or take it at home in their own food containers.
Art. 7. The activities of the canteens /soup-kitchens/ are organized and managed by the respective Secretariats of Regional / City Councils of the Bulgarian Red Cross according to their location.
Art. 8. The working time of the public canteens /soup-kitchens/ has to coincide with the working days of the week. The food sustenance is to be distributed between 11.30 h. and 14.00 h.
Art. 9. One meal per day lunch is to be served at the public canteens /soup-kitchens/.
Art. 10. The canteens /soup-kitchens/ have to dispose of qualified personnel, possessing the necessary qualification certificates, enabling them to work at catering establishments.
Art. 11. Volunteer workers can assist the service to the beneficiaries in case they possess the necessary qualification certificates, enabling them to work at canteens /soup-kitchens/ - in case they are properly dressed and carry the sign of the Bulgarian Red Cross.

PART II
Conditions for granting food sustenance at public canteens /soup-kitchens/

Art. 12. The Bulgarian Red Cross is entitled to grant food sustenance at the established public canteens /soup-kitchens/ in accordance with its capacity to citizens, who have preliminary applied for such aid as per the regulations stated in Part III of this Regulation, and who meet the following requirements:
Bulgarian citizens as well as foreigners, after having acquired either refugee or humanitarian statute on the territory of the Republic of Bulgaria, who can not be afforded fundamental vital needs due to various health, age, social or other reasons beyond their control; and whose personal average monthly income amounts under 80 % of the minimal salary for the state; and respond at least to two of the criteria listed below:
1. Permanent reduced capacity for work over 50 %.
2. Retired citizens over 65 years old.
3. Citizens who live alone.
4. Citizens, who have acquired the age for retirement without right of pension.
5. Unemployed citizens, who do not receive compensations by the Employment Department belonging to the state.
6. Citizens in difficult financial situation due to an illness of a member of their families.
7. Citizens, who are unable to prepare meals alone at their homes.
8. Citizens, who have not profited assistance through other food sustenance programs.
Art. 13. The management of the Secretariats of the Regional / City Council of the Bulgarian Red Cross can determine supplementary criteria on a local level for facilitating the selection of the target group /beneficiaries/, according to the criteria for food sustenance depending on the specific condition of the respective region.

PART III
Granting System
Art. 14. /1/ The citizens in needy circumstances are entitled to apply for food sustenance at the public canteens /soup-kitchens/ by submitting the following documents at the respective Regional /City Council of the Bulgarian Red Cross:
1. Application (see the enclosed sample in Appendix 1)
2. Declaration (see the enclosed sample in Appendix 2)
/2/ An employee from the respective Regional / City Council of the Bulgarian Red Cross is in charge of filling in a social questionnaire (see Appendix 3), valid for the current calendar year.
/3/ Depending on the specific nature of each case, the Secretariat of the respective Regional / City Council of the Bulgarian Red Cross is entitled to demand some of the following documents as well: certificate for working activities; decision for pension; medical certificates indicating the health condition of the beneficiaries / certificate, expert's report, protocol; copy of expert decision of Labour Expert Physicians' Committee; document by the Employment Department belonging to the state, certifying that the respective citizen is unemployed; document by the Social Care Authorities, certifying that the citizen does not receive social assistance, or when and what kind of social assistance has been received by him / her, etc.
Art. 15. The applications as per Art. 14 have to be registered under incoming numbers at the Clerk's Office of the respective Regional / City Council of the Bulgarian Red Cross.

PART IV
Accounting and Control
Art. 16. The applications of the citizens have to be evaluated and approved by a commission, consisting of: the President of the Regional/City Council of the Bulgarian Red Cross, the Director of the Regional/City Council of the Bulgarian Red Cross and the Social Assistance Expert.
Art. 17. An employee of the Regional/City Council of the Bulgarian Red Cross has to prepare a list of the beneficiaries approved for granting food sustenance at the public canteens /soup-kitchens/ of the Bulgarian Red Cross (see Appendix 4) for the respective month.
Art. 18. The above-mentioned lists contain the following information: the full name of the beneficiaries, their personal identification number and their income. The Director of the Regional/City Council of the Bulgarian Red Cross is entitled to approve the applications up to 25th of the previous month.
Art. 19. The approved beneficiaries have to receive the previous month the coupons for granting food sustenance, signed by the Director of the Regional/City Council of the Bulgarian Red Cross and stamped at the Regional/City Council of the Bulgarian Red Cross.
Art. 20. The coupons are to be distributed monthly against a signature of the beneficiary, and the number of the coupon has to coincide with the number of the beneficiary in the list (see Appendix 4).
Art. 21. Each coupon is valid for a single use at the exact date, and cannot be compensated for or disposed of another person.
Art. 22. In cases of absence of any of the beneficiaries at the time determined preliminary for granting the food sustenance, the food has to be given to another waiting beneficiary, or to be wasted by means of a protocol (see Appendix 5), signed by the Director of the Regional / City Council of the Bulgarian Red Cross.
Art. 23. In cases of absence of any of the beneficiaries within 5 successive days, he/she has to be replaced by another person, who meets the required criteria stated in Part II.
Art. 24. When granting financial resources for providing food sustenance coupons by external donors, in case of presence of concrete requirements for the accounting forms or any other supplementary documentation, the conditions and the will of the donor is to be observed.
Art. 25. The Directors of the Secretariats of the respective Regional / City Councils of the Bulgarian Red Cross are in charge of providing appropriate warehouses for storing the alimentary products, used for preparing the food at the public canteens /soup-kitchens/ as well as of the overall control of the activities concerning the book-keeping process, the proper storing of products and the entire working organization of the respective public canteen /soup-kitchen/.
Art. 26. The employees, who have violated the present Regulation, are subject to disciplinary measures; in cases of incurred damages, violations or other infringements against the Bulgarian Red Cross, the responsible people bear property, civil and penal liability for their actions.
Art. 27. Legal disputes arisen in the course of implementation of this Regulation shall be settled voluntarily by mutual consent; in cases of lack of mutual consent, the disputes has to be submitted before the competent court authorities as regards to the location of the respective council of the Bulgarian Red Cross in accordance with the Bulgarian legislation.

Supplementary Instructions
1. The statute of refugees and people having humanitarian statute is determined by Art. 8 and Art. 9 of the Public Act on Refuge Provision and Refugees.
2. "Fundamental vital needs" stands for sufficient amounts of food, clothing and accommodation in accordance with the social and economic situation of the country.
3. Unemployed are considered the people, who have been registered at the Unemployment Department belonging to the state, and who actively search for a job.
4. The following financial assistance are not considered as incomes:
  • Aid granted under the clauses of the Regulation for Financial Assistance by "Charity" Fund and the Regulation for application of the Act on Social Assistance;
  • The allowance for personal assistance to people with increased immovability and reduced working capacity evaluated as 90%
  • One-time aid for birth of a child under Art. 6 of the Act on Family Assistance for Children
  • Humanitarian aids
  • The one-time compensations added to the pensions or supplementary pensions
• Supplementary amounts added to the pensions of the veterans, volunteers or the citizens, subjects to sufferings during the Patriotic War as well as the citizens, subjects to sufferings during executions of missions of the UN military contingent.
  • Supplementary monthly compensation added to the pensions of citizen over 75 or 80 years old.
